Entertainment general terms and conditions of sale
1. General Information: Unless otherwise specified in a contract, all orders placed with us and all contracts we process are subject to these general terms and conditions of sale, which take precedence over any purchase terms. These general terms and conditions of sale apply to all services and product sales performed by our company. Unless otherwise agreed, the contractual relationship is established exclusively between the direct client and our company. A personalized quote is required for each service. A site visit to the venue where the event will take place must be scheduled prior to the event to confirm the suitability of the activity for the client's premises. Only orders submitted by the client in the form of a contract, purchase order, or dated quote, bearing the words "approved," the company stamp, and the signature of the client's legal representative, will be considered valid.
2. Prices: Prices are quoted excluding or including all taxes based on the rates in effect on the date the offer is submitted. (Valid for 14 days after its date of issue). The applicable taxes are those in effect on the invoice date.
3. CrashKart France will provide a turnkey service, including fully installed and dismantled equipment, and will ensure the activity is run by supervising staff. The organizer may provide supervising staff, but this must be specified in the contract.
4. Payment Terms: Payments are made by check, cash, or bank transfer. A 50% deposit of the total amount including VAT guarantees the validity of the order. The balance (50% of the total amount including VAT) is due on the day of service upon presentation of the invoice, unless otherwise specified in the contract. Any payment not made by the due date indicated on the invoice will place the client in default. Late payment penalties may be applied by the company to the client, resulting in a surcharge of 10% (10 points) of the outstanding balance payable by the client. 5. Insurance: Regarding the services provided, please note that CrashKart France is covered by Civil Liability insurance with MMA – 7 rue du Général Leclerc – 80000 AMIENS – BP 30806 - 480 167 766 RCS Amiens – ORIAS No.: 07010468. This insurance covers only accidents that our company or equipment may cause. It does not cover accidents for which we are not liable, such as failure to comply with safety rules posted on the structures or given by our staff. In all cases, the client must take out their own insurance to cover their activity day.
6. Postponement Conditions: Due to weather conditions, inclement weather, or other significant circumstances (declared or undeclared war, general strike, epidemic, quarantine, fire, exceptional flooding, accidents, or other events beyond the control of both parties), CrashKart France and the client may postpone the service to a date to be agreed upon by both parties (subject to availability). This new service must take place within the following three months at the latest. Any outstanding amounts owed by the client are due on the date of postponement.
7. Cancellation Policy: In the event of inclement weather or other unforeseen circumstances, the client must ensure they have an alternative venue or reschedule the service date. Otherwise, if the client and CrashKart France are unable to agree on a new service date within 3 months of the quote acceptance, the booking deposit already paid by the client will be non-refundable or will be credited towards future services.
8. CrashKart France cannot be held responsible for any consequences that may arise from misuse of the equipment made available to the customer or from failure to comply with safety rules on the date of the event requested by the customer: due to severe weather preventing its assembly, if the installation already assembled has suffered damage that renders it unusable, if during the period preceding the date of this commitment, the effects of a disaster or breakdown no longer allow the assembly of a structure, if an accident noted by the police or bailiff makes assembly impossible within the scheduled time, if road blockages, demonstrations, strikes, public calamities prevent assembly within the scheduled time, if a prolonged power outage makes the use of the equipment impossible.
9. Special Conditions: Especially in the event of a tear in the tarpaulin, whether caused by the client or their users, or by vandalism or other means, if the structure must be dismantled to prevent further damage, the renter will not be entitled to any compensation, even if the event cannot take place. The service fees will be due in full, plus the cost of repairing or replacing the tarpaulins and compensation equal to these costs. CrashKart France is solely responsible for assessing the extent of the damage and anticipating its potential consequences. The client acknowledges that it is forbidden to: write on the equipment in any way, tape posters to the tarpaulins, enter the structure barefoot, drive nails or pins into the equipment, cut the tarpaulins, or use paint, pens, colored powder, etc. Users must also wear appropriate clothing for the activity organized by CrashKart France.
10. Specific Conditions: The client is responsible for providing a compliant electrical supply, safety barriers (to manage crowds and protect equipment), and vehicle parking. The area reserved for the equipment must be completely clear, level, clean, significantly larger than the structures to be installed, and accessible by van. For long-term events (exceeding one day), 24/7 equipment monitoring is the client's responsibility, unless otherwise specified in the quote. The client must submit a written declaration and/or authorization to the relevant authorities when the installation is on public property.
11. Applicable Law: This contract is governed by French law. In the event of any dispute concerning its interpretation or performance, the court of Saint Quentin (02) shall have sole jurisdiction.
